HEREINAFTER CALLED AS THE ‘DEVELOPER’ (Which expression shall unless repugnant to context or meaning thereof to be deemed to mean and include his representative heirs executors and assigns)
---PARTY OF THE SECOND PART

And whereas the property which more particularly described in the Schedule hereunder written and hereafter to referred to as to said property has been purchase by the Declarants from the Developer by virtue of different Sale Deed and Development Agreement, the details of which has been given in the ‘Annexure A’ attach to this document.

And Whereas the Developer has also handed over the, vacant, peaceful, physical and actual possession of the said property to the Declarants at the time of execution of the documents referred to in the ‘Annexure A’.

And whereas the Developer has received the entire consideration, from the Declarants at the time of the documents referred to in ‘Annexure A’.
And whereas the names of the Declarants have also be entered in the revenue record in respect of the said property.

And whereas after the execution of the documents referred to in ‘Annexure A’ and after the handling over of possession and necessary mutation in the revenue record one Shri. Vitthal Narayan Tarate started claiming, right, and interest in the said property.

And Whereas the Developer or the Declarants were not aware about the claim and/or litigation made by Shri. Vitthal Narayan Tarate, at the time of making the documents referred in ‘Annexure A’
And whereas the Declarants under such situation, requested the Developer to help them out of the situation by making seyylement with Shri. Vitthal Narayan Tarate.

And Whereas since the Developer is also holding land adjust and to the said land and since Shri. Vitthal Narayan Tarate is also claiming interest in the adjoin land held by the Developer, the Developer accepted the request of the Declarants and as a moral responsibility agreed to settle the issue with Shri. Vitthal Narayan Tarate.

And whereas despite efforts, due to some difficulties, the Developer could not make out a settlement with Shri. Vitthal Narayan Tarate.

And whereas the Declarants themselves approach Shri. Vitthal Narayan Tarate and were successful in reaching a settlement with Shri. Vitthal Narayan Tarate.

And whereas the Declarants requested the Developer to reimburse the Declarants the amount paid by them to Shri. Vitthal Narayan Tarate.

And Whereas the Developer as a moral responsibility accepted the request of the Declarants and decided to pay to the Declarants the sum of RS………. to the Declarants on the terms and conditions mentioned below.

NOW THEREFORE THIS INDENTURE WITNESSES AS UNDER:-

The Developer has paid the declarants a sum of Rs/-…………., as described in clause (2) of detail, thereby discharging his moral liability of settlement of the claims of Shri. Vitthal Narayan Tarate.

3. The Declarants hereby declare that the Developer has duly conveyed the title, ownership, right and interest in the said property to the Declarants, to the satisfaction of the Declarants.

4. The Declarants hereby declare that they have discharge, acquitted the Developer from the moral libility of settling the claim of Shri. Vitthal Narayan Tarate.

5. The Declarants further declare that they have executed necessary Transferred of Deed with of Shri. Vitthal Narayan Tarate thereby acquiring all his rights and interest in the said property and have paid due and appropriate consideration to of Shri. Vitthal Narayan Tarate.

6. The Declarants further declare that all or any formalities which my further required in order to extinguish the claim of of Shri. Vitthal Narayan Tarate , including but not limited to, execution of the documents, making of application etc. in the court and other such formalities shall be done by the Declarantson their own and at their own cost as the Developer has already reimburse the Declarants for the same.

7. The expenses related to the present document as owned by the Developer.
